Terms of Use for IRCPlus’ Services

  1. You must be older than 13 years of age or older.
  2. You must have (and maintain) an account with IRC4Fun’s Services (NickServ).
  3. You must have (and maintain) a valid email address with IRC4Fun’s Services (NickServ).
  4. You must comply with all server and network policies. (Usually indicated via /MOTD, /RULES, & via website.)
  5. You may not use your TheLounge or ZNC account to evade bans.

TheLounge Accounts

  1. You must use the username of your IRCPlus account in the username field (under Settings > User Preferences)This is strictly enforced.
  2. You must login and use your TheLounge account at least once a month, or it will be marked as inactive and suspended.
  3. You may not use your account to evade bans, flood or spam IRC networks.

ZNC Accounts

  1. You are (by default) limited to 3 networks at a time.
  2. You must login and use your ZNC account at least once a month, or it will be deleted.
  3. You may not use your account to evade bans, flood or spam IRC networks.

Setting up an Account

You must be of legal age and capable, in your country of residence, of entering into a legally binding agreement to use the Service.

You are responsible for maintaining the confidentiality of your login details and any activities that occur under your Account. If you have any concerns that your Account may have been misused, you should contact us at support @ IRCPlus.net away to let us know.

Account content & allowed use

IRCPlus provides TheLounge & ZNC services to it’s registered users free of charge.  The service is intended to provide a fully-featured, IRCv3 compliant, always-connected IRC client for use on IRC4Fun and additionally desired networks.

You grant us a worldwide, non-exclusive, royalty-free and perpetual licence to use, copy, reproduce, distribute, adapt, re-format, modify, publish, translate, licence, sub-licence any images, sounds, text or information that you access, store, distribute or transmit (“User Content”) for the purposes of providing the Service. For details about how we protect the privacy of User Content, please read our Privacy Policy.

You shall not access, store, distribute or transmit any viruses or User Content during the course of your use of the Service that is unlawful or illegal or facilitates any unlawful or illegal activity; infringes another person’s rights; or breaches applicable privacy rights or laws.

We may, without responsibility to you, disable the Service to the extent necessary to disable access to any data or material that breaches our Rules of Acceptable Use.

Failure to comply with Rules of Acceptable Use constitutes a serious breach of these Terms of Service, and may result in your immediate, temporary or permanent withdrawal of your right to use the Service.

Violation of these Terms of Use

Violation of the above terms may result in your IRCPlus account(s) being suspended or purged.

Data Retention

Data (such as Channel Messages, Private Messages — also referred to as “scrollback”) is housed in  Canada  and retained for 90 days.  Data older than 90 days is purged in order to preserve space and provide optimal performance of TheLounge server.

Data from accounts which are purged (either at the owner’s request or due to violations of these Terms of Use) will be permanently destroyed after 90 days.

Data from accounts which are inactive (or have not logged in within 30 days) will be permanently destroyed at the time of account suspension or termination.

Cancelling your Account

Users who wish to drop their account should send an email to support @ IRCPlus.net (from the email address associated with your IRC4Fun NickServ Account) with the subject “IRCPlus: Please delete my account” and include the following:

  • IRCPlus username
  • Service Type (TheLounge or ZNC)
  • NickServ Account (Do NOT include your NickServ or TheLounge password)

(This is to authenticate the owner of the account & to reply with confirmation or additional information.)

Our liability/responsibility to you

The Service may contain links to other sites and resources provided by our users and third parties (“Third Party Content”). We do not produce this Third Party Content and cannot be responsible for it in anyway. You access the Service and use it at your own risk.

IRCPlus will use reasonable endeavors to make the Service available except for:

  • Planned maintenance for which 24 hours advance notice will be given; or
  • Unscheduled maintenance, during which we will use reasonable endeavors to keep you up to date.

Unfortunately, due to the nature of the Internet and technology, the Service is (save as provided above) provided on an “as available” and “as is” basis. This means that we are unable to promise that your use of the Service will be uninterrupted, without delays, error-free or meet your expectations and we do not give any commitment relating to the performance or availability of the Service in these Terms of Service and, to the extent we are able to do so, we exclude any commitments that may be implied by law.

In every case, we will never be responsible for any loss or damage as a result of your use of the service.
